  • Sexual Assault Charges Dropped
    A soldier was accused of sexually assaulting a minor. After being pressured into giving a statement to military investigators, he made statements indicating guilt after law enforcement kept urging him to confess, despite his protests. He felt the confession was coerced, but the military took him to court martial anyway. Counsel for Owens & Kurz was able to demonstrate the unreliability of both ‘confession’ and the alleged child victim and received an alternative disposition.

    Twenty-one years ago, a soldier was discharged with an under other than honorable conditions discharge. Since then, she has risen through the ranks of her industry and profession without any issue until a state questioned the meaning of her OTH discharge in lieu of court-martial, wrongly calling it a conviction and demanding she sign a settlement and withdraw her application or face adverse action. Owens & Kurz was able to submit a brief educating the State on its misinterpretation and convincing them to award her professional license.

    A Senior Non-Commissioned Officer (NCO) in the Army was accused of making a false official statement to investigators and defamatory comments about the Military. Following a week-long contested trial at court-martial, the military jury panel acquitted the service member of all charges. The NCO has since successfully been returned to a leadership position and been promoted with back pay.

    An Army officer was accused of sexual contact. Owens & Kurz attorneys were able to win a retention at his Board of Inquiry (BOI) administrative separation hearing, and then fight through the retirement process with him, allowing him a full and honorable retirement.

    Owens & Kurz represented a client in the illegal possession of a firearm. Law enforcement stopped M.R. while driving, stating he was driving erratically when the facts and video showed he was not.
